Terms of Service
Last updated 29 October 2026
Welcome to Trifta. These Terms of Service ("Terms") govern your use of the Trifta mobile application, website, and related services (collectively, the "Platform") operated by Taslina Nazar, a sole proprietor based in India, trading as "Trifta" ("Trifta", "we", "us", "our"). By creating an account, listing an item, or making a purchase, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
1. What Trifta Is
Trifta is a peer-to-peer marketplace that lets individuals in India buy and sell pre-owned and new fashion items (clothing, accessories, footwear). Trifta is a venue only - we do not own, inspect, or warehouse any item listed by a seller. Each transaction is directly between the buyer and the seller.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract under Indian law to use Trifta. You must provide accurate information when creating your account and keep it current.
3. Your Account
You are responsible for safeguarding your login credentials and for all activity under your account. Notify us immediately at support@trifta.in if you suspect unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably suspect are being used for fraud or other illegal activity.
4. Listings and Seller Obligations
If you list an item for sale on Trifta, you confirm that:
- You own the item outright and have the legal right to sell it.
- The item description, photos, condition, size, and brand are accurate and not misleading.
- The item is not counterfeit, stolen, recalled, or otherwise prohibited by Indian law.
- You will ship the item within the dispatch timeline you publish, using trackable courier service.
- You will respond to buyer messages promptly and honour the shop and returns policies you have selected.
5. Prohibited Items
You may not list items that are illegal to sell in India, counterfeit goods, hazardous materials, used undergarments, items made from endangered species, or any item requiring special licensing to transfer. We reserve the right to remove any listing at our sole discretion and to suspend sellers who repeatedly violate this policy.
6. Orders, Payments, and Platform Fee
Payments on Trifta are processed by Razorpay. When a buyer purchases an item, the full amount (item price plus any shipping fee) is captured and held by Trifta until the order is confirmed delivered or five days pass without a dispute. Trifta then releases the seller's share to the seller's verified bank account, minus a platform fee of 10% of the item subtotal.
Buyers are solely responsible for the amount at checkout. Sellers are solely responsible for income tax, GST (if applicable), and any other statutory obligations arising from sales on the Platform.
7. Returns, Refunds, and Disputes
Returns are governed by each seller's declared returns policy, shown on the listing page. If an item arrives significantly not-as-described, damaged in transit, or not at all, the buyer may open a dispute within five (5) days of delivery through the Platform. Trifta will review evidence from both sides and may rule in favour of a full refund, partial refund, or the dispute being closed in the seller's favour. See the Refund Policy for full details.
8. Buyer Obligations
Buyers agree to pay in full for items they purchase, to provide accurate shipping information, to inspect items on delivery, and to raise any issue through the Platform rather than through external channels. Fraudulent chargeback attempts are grounds for account termination.
9. Intellectual Property
The Trifta name, logo, and all Platform content we publish are our property. You retain ownership of the photos and descriptions you upload for your listings but grant us a worldwide, royalty-free, non-exclusive licence to host, display, resize, and distribute them in connection with the Platform and our marketing.
10. Prohibited Conduct
You may not:
- Transact outside the Platform to avoid the platform fee.
- Harass, abuse, or discriminate against other users.
- Scrape, reverse engineer, or interfere with the Platform's operation.
- Create duplicate or fake accounts to manipulate reviews or ratings.
- Use the Platform for any purpose that violates Indian law.
11. Limitation of Liability
To the fullest extent permitted by law, Trifta's total liability to you for any claim arising out of your use of the Platform is limited to the greater of (a) the platform fees we have collected from you in the three months preceding the claim, or (b) ₹5,000. Trifta is not liable for any loss arising from the acts or omissions of other users (buyers or sellers), including non-delivery, misrepresentation, or damaged goods, except to the extent our dispute resolution process rules in your favour.
12. Indemnification
You agree to indemnify and hold harmless Trifta, its proprietor, and its service providers from any claims arising out of (a) your breach of these Terms, (b) the items you list or purchase, or (c) your interactions with other users.
13. Termination
You may close your account at any time from the app. We may suspend or terminate your account for breach of these Terms, suspected fraud, or inactivity. Sections 6, 9, 11, 12, 14, and 15 survive termination.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of India. Any dispute shall first be attempted to be resolved amicably between the parties. If unresolved, the dispute shall be subject to the exclusive jurisdiction of the courts in Kochi, Kerala.
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified in the app and by email where possible. Continued use of the Platform after changes become effective constitutes acceptance of the revised Terms.
